KNOWLEDGE AND REPUTATION First off, let me say that my wife and I had probably as complicated a situation involving bankruptcy as you are likely to find. Like many couples in California, we depended on two incomes to pay our mortgage, and other monthly payments. My wife developed a job related illness, and was no longer able to work. As a consequence; with a single income and additional medical costs, we could no longer afford to live in California. We were in the process of selling our California home and purchasing a much more affordable home in Nevada when we began the bankruptcy process. We had some modest savings, and other assets that had to properly be accounted for and utilized correctly. Additionally, there are precise timing and other considerations when filing bankruptcy in one state while in the process of moving to another. Moreover, the bankruptcy laws in general are very complicated, and in many cases are counter-intuitive. If you are considering filing for bankruptcy you NEED an attorney and a GOOD ONE. There were a substantial amount of details, that we fully discussed, and strategized with our primary attorney Raj Wadhwani. We were then able to put in place a step by step plan to achieve the best possible outcome. I say that Raj was our primary attorney (and he deserves the lion’s share of the credit for the successful outcome) but the fact is we really felt we had a full team working for us. On several occasions I also spoke to Greg Shanfeld, and had a number of additional conversations with the associate attorneys and support staff. It is worth noting that despite the additional complications involved (and therefore additional time and effort required) there were no additional charges, as W&S operate on a flat fee basis. So, in the end, there were a number of issues that could have been challenged by the bankruptcy Trustee. But not only had we covered all the bases in advance, but it was clearly evident to me that the Trustee’s experience was that W&S would be thorough, and would do things CORRECTLY. In other words, my attorney had a REPUTATION to KNOW AND TO DO the right thing. Our case was settled promptly, and with the best outcome we could ever had hoped for. I’ll sum it up like this; if you have a simple case, you SHOULD use W&S, if you have a complicated case you MUST use W&S. There is simply no substitute for having the KNOWLEDGE to get the job done, and the REPUTATION for doing just that. Dear Greg, Thank you for your assistance with our financial situation. After continuing medical issues, we fell behind in our payments to all of our creditors. We applied for a Home Loan Modification. We were offered 3 or 4 modifications from our lender, which were still unaffordable. As a result, our house went into foreclosure. This became a very stressful time for our family. We heard you on the radio and called for an appointment. Your law firm was very professional and sympathetic to our situation. Our first priority became saving our home. We immediately filed Chap 13 because we wanted to work out a plan to pay our creditors. Originally, we were able to make some of the payments, and then when medical issues arose again, we were unable to continue. We had to change our bankruptcy to a Chapter 7. We were able to discharge all of our debt and the second mortgage on our home was completely wiped out. When our bankruptcy was discharged we applied again for a home loan modification. Soon after our discharge date our lender offered a home modification reducing our monthly payment by $1500 and because we were upside down in our mortgage, they also offered us a principal reduction in excess of $200,000. We thank God for you for walking us through this entire difficult process. We now are current in our mortgage and our living expenses no longer exceed our income. I have recommended your firm and shall continue to recommend your firm because you all are knowledgeable in this entire process, you know how to help your clients remain calm throughout the entire process and your staff is very courteous.
